Joe Simpson secretly took out a $4.5 million life insurance policy in daughter Jessica’s name with himself listed as the sole beneficiary, a source tells RadarOnline.com exclusively.

The policy was drafted around 8 years ago, the source says, and The Dukes Of Hazzard star and her mom Tina only found out about its existence last week.

Tina’s attorneys at Dunnam & Dunnam were made aware of the policy’s existence in a meeting with the Simpsons’ business manager, David Levin, and the source says that both Jessica and Tina are “furious” that Joe had done such a thing without the knowledge of either of them.

“Tina found out about yet another one of Joe’s secrets and couldn’t believe what she was hearing,” the source, who is close to the Simpson family, tells RadarOnline.com.

“It came out in a meeting with David and her attorneys last week that Joe set up a life insurance policy for Jessica 8 years ago that made him the sole beneficiary.

“It was pointed out to Tina that as Jessica’s manager Joe wasn’t doing anything underhanded by taking out a policy to protect his biggest income source, but she was absolutely furious that Joe did it without consulting her or Jessica.

So here it is the question:

Can I buy life insurance for someone else?

The simple answer is, “yes”. You are allowed to pay the premiums and collect the benefits on a life insurance policy that insures a life that is not your own. For example, many people have life insurance on their children. Another example is that companies sometimes buy life insurance on their key employees so that they can recover from the negative financial effect that losing that employee might cause.

There are two things that you need to consider. One, you are going to need to have the consent and participation of the person whose life is being insured. Two, you are going to need to provide a reason to the insurance company that you will be affected financially if the insured dies. The only exception to this is life insurance on children. Usually the parent of a minor can purchase life insurance on the child without any additional reasons. If you have nothing to lose from the death of the person, then you don’t really have an “insurable interest” and in such cases would only gain financially from the death of the insured. Just being a relative does not necessarily create an insurable interest. You will have to prove that you are somehow financially affected by the death of that particular relative.

I had the pleasure of obtaining a final expense plan several years ago for Petelo Alailetaleula, a Samoan immigrant who had an interesting story about his culture.

Petelo was a charming, gentle giant, standing 6’1” and weighing 379 pounds, and he preferred people call him Peter. When I knocked on his door (final expense sales are most effective when you visit people instead of calling them on the phone), he was 62 years old, with high blood pressure and type 2 diabetes. He was concerned about his health and whether he could buy a simple, inexpensive life insurance plan. I assured him that with liberal underwriting, no medical exam and no home office specimen, he would get approved for a small final expense policy ranging from $3,000 to $25,000.

With his limited budget, we agreed that $10,000 would be sufficient. He had life insurance for funeral costs from his trade union, but his wish was, as is with many foreign nationals, to return to the country where he was born for his final resting place. Peter knew from previous Samoan passings in his Los Angeles community that shipping the body is extremely expensive, and he didn’t want to burden his family, friends and church members with these expenses.

Charges for transporting human remains (or HR in airline terms) are based on destination, the number of transfers required and different airlines needed, as well as the combined weight of the casket, body and air tray. It’s not uncommon to see international charges from the airlines ringing up at about $6,000.

Final expense policies can often solve the problems posed by these transport charges, and not just for Samoans.

My client and my friend, Peter died just three years after I placed his protection plan, but I’m glad to share that he’s back in Samoa, his homeland. His wishes were honored. Thanks to final expense, he had his final flight.

Letter of Wishes


You may already have a will and a Power of Attorney or Living Will, but have you thought about who will handle important financial matters and what your wishes are in the event of your death?    I suggest that you write a letter to your family, typically addressed to your spouse (usually the executor of your will). You may also want to address the letter to your children, particularly if they are the primary beneficiaries of your estate. This letter is meant to provide assistance and guidance to your family regarding items not covered in your will. It will not change your will. Here are some points to cover in your letter:
  1. Funeral and burial arrangements: Where, by whom, what kind, and at what cost?

  3. Anatomical gifts: Identify the nature and location of any anatomical gift declarations you have made.

  5. Memorials and contributions: Identify what organizations or institutions might be appropriate recipients of memorials or charitable donations made in your memory.

  7. Preparation of obituary: Should your obituary be prepared in advance and updated periodically? To which newspapers or websites should it be sent?
  8.  
  9. Notifications of friends, relatives, business associates, and colleagues in charitable or civic groups. Identify those persons to be contacted upon your death, noting any particular requests or messages to be given, and listing their current addresses and phone numbers.
  10.  
  11. Location of your safe-deposit box and its key.
  12.  
  13. Location of your will and estate planning documents: Include any trusts, buy/sell agreements, or extraneous writings incorporated in your will.
  14.  
  15. Medical and hospital coverages and location of the policies.
  16.  
  17. Social Security and Veterans Administration benefits: Identify current or potential benefits.
  18.  
  19. Life insurance: Indicate where policies are located and what steps should be taken to collect policy proceeds.

  21. Location and explanation of title documents and other records relating to your assets. Include deeds, stocks, bonds, bank accounts and deposits, retirement plans, and vehicle titles.

  23. Identify obligations involving periodic payments, such as your home mortgage, car loans, and other debts, including amount and to whom payable.

  25. Identify your attorney and professional advisers (including your accountant, broker, trust officer, and insurance agent) who you currently use or recommend.

  27. Key employees and business friends to keep business operating until sale. Remember, the value of an ongoing business is much greater than a closed one.
